Confidentiality agreement in contract
« on: August 11, 2023, 10:04:18 am »
Hello, I won't say what the school is  (to avoid potentially getting in trouble) but I have a teaching contract I've been offered and one of the provisions of the contract is that the instructor is (I am) not allowed to reveal the terms of the contract to any third party, including other employees of the school. I've never seen such a provision in a contract. Does anyone find that fishy? Is it legally enforceable?

take that part out of the contract.  if they are unwilling to take that part out, then it sounds fishy.

I couldn't say if it's legally enforceable here in Korea, but whenever you see this kind of policy or stipulation, it's often code for shenanigans.

Some things are related to industry secrets, in which case NDAs are not only understandable, they're necessary; however, even then, it's fairly explicit about what can or cannot be shared because there's a lot that isn't protected by NDAs as it would be in violation of law and legal rights.

For places like hagwons and the like, these types of clauses are usually there to prevent discussion of wages and shady/illegal labor practices (especially when they stipulate that you can't even discuss your own contract with fellow employees). In the States, this is definitely illegal, and it would not be legally enforceable no matter how they word it in a contract. In Korea, I wouldn't think so, but I can't confirm.

At the very least, it's a red flag. I personally wouldn't work for the place that would put in a clause like this. That's not a fight I would want to have to fight should it turns out that, yeah, they were trying to hide some shit.

But I agree with Bakeacake, you could just ask them to remove it from the contract, see how they react. It's possible that this is just another generic contract they downloaded from somewhere without fully assessing the contents. I personally think this is more of a recent attempt to avoid getting their shitty contract blasted in public, though, because it's probably happened to them before.

Companies of all types at home and abroad have this sort of stipulation for one reason - to keep wages artificially low and to keep the working man down.

Exactly.  If you are new in an afternoon hogwan demand at least 2.5.  If you are an all day kindie demand 2.8 to start.  If you have more experience, demand even more like 3 million won a month.  If this clause to pay you poverty wages like 2.2 million and then expect you to shut up about it, then simply reject and say "next".
