I was going to post something on the "When Will Trump Get Arrested?" thread about the cycle that will inevitably unfold now that civil charges for fraud have been filed against the Trump family, and criminal charges are clearly in the pipeline.

1. It's not a crime.
2. If it's a crime, then it's a small one.
3. If not's not a small one, there's no precedent for prosecuting people for it.
4. If there is such a precedent, Hunter Biden's laptop.

Will also be interesting to see what path Martino / JVC takes. I'm going with something like, "The layman's understanding of asset valuation makes it look that Trump committed fraud, but that's only if you know nothing about tax law, sophisticated accounting mechanisms, shell company asset shielding, and risk assessment in the insurance and loan industry. If you seriously think that every business bar the Trump Organization is entirely honest about the exact valuations of its assets..."

Uhm, I have to point out that civil charges mean, by definition, that no crime has taken place, hence why there is civil court and criminal court. Thus, 2, 3 and 4 are all not applicable.

The civil charges are pretty much an indication that the AG lacked sufficient evidence to support a criminal filing and thus are resorting to civil court where there is a lower standard.

I don't know if there is precedence for this kind of case and whether the amount requested is likely to be awarded. I also don't know what the appeals process is and the chances that this whole thing could get squashed before, during or after trial. Then there will be the process of trying to extract whatever money they can from Trump.

Regardless, this is going to go on for awhile. Anyways, it's civil court. Whatever. Trump loses, who cares?

Anyways, as to whether what he did regarding valuation of property and tax stuff was standard or not, I don't know. If I had to guess, not unprecedented and likely had stood up to legal challenge (or modest fines) in previous cases, but probably not standard practice either and really pushing the envelope.

Even the articles you linked point out that the case has been referred to criminal prosecutors. That's why I said a criminal case was "in the pipeline". And no, criminal and civil charges are not mutually exclusive. You can go to jail for killing someone in a drunk driving accident and get sued in civil court by the victim's family.

This conduct was in violation of New York Executive Law 63(12), which gives the Office of the Attorney General (OAG) special and broad powers to go after persistent and repeated fraud and illegality, which in this case includes violating other state laws prohibiting the submission of false financial statements, the falsification of business records, and the commission of insurance fraud.

As a consequence of these violations, OAG is seeking, among other relief, to: 1) permanently bar Mr. Trump, Donald Trump, Jr., Ivanka Trump, and Eric Trump from serving as an officer or director in any New York corporation or similar business entity registered and/or licensed in New York state; 2) bar Mr. Trump and the Trump Organization from entering into any New York real estate acquisitions for five years; 3) award disgorgement of all financial benefits obtained through the persistent fraudulent practices, estimated to total $250 million.

In conjunction with the lawsuit, OAG has referred the matter to the U.S. Attorney’s Office for the Southern District of New York and the Internal Revenue Service (IRS) for criminal investigation.

The whole document is certainly worth a read. Even if only half of it were valid (say, he only scammed $125 million, or half the inaccurate asset valuations were honest mistakes), there'd still be a strong case for criminal fraud.
