Contract review, please help. New to teaching

CLAUSE 1 (APPOINTMENT) / 제1항 (임 명)
a. The employer agrees to employ the teacher during the period stipulated herein.
b. The teacher agrees to accept employment and will work in his/her full capacity for the school.



CLAUSE 2 (PERIOD OF EMPLOYMENT) / 제2항 (고용 기간)
a. The total Agreement term is for one year, commencing from the first teaching day, ending on the
last teaching day of the teacher's twelfth full teaching session, according to the .... session calendar.


b. During the duration of this contract and without prior consent of the employer, the employer will
deny a release letter to the employee seeking another job position elsewhere.


CLAUSE 3 (THE EMPLOYER’S RESPONSIBILITIES) / 제3항 (사용자의 책임)
a. The employer is required to provide support to the teacher in his/her full capacity, working
together to provide quality English instruction under the terms stated in this contract. This
includes a furnished apartment. Housing bills and household items are teacher’s obligation. Final
cleaning fee will be deducted when you finish your contract.
The apartment will be offed to the employee on teacher’s arrival day, and cleaned. It must be
returned to the employer in the same condition when the employee leaves the institute. The last
salary will be paid after deducting the housing bills or confirming paid last bill. A free economy
class one- way airfare ticket will be provided to teacher, by the employer, to fly teacher from the
international airport closest to teacher’s original home address if the teacher fulfilled the contract.
If the teacher dismiss before the contract, airfare will not be provided.

b. The employer will honor the terms and conditions of employment, as stated within this contract.


CLAUSE 4 (THE TEACHER’S RESPONSIBILITIES AND DUTIES) / 제4항 (교사의 책임과 의무)
a. During the terms of this Agreement, the teacher must cooperate and comply with the instructions
and disciplines of the school. Assisting the ‘Supervisor’ or ‘Director’ he/she must carry out
assignments as directed by the employer. The ‘Supervisor’ or ‘Director’ will be responsible for
establishing and communicating the ‘Standards of Performance’ as related to the duties stated in
this contract.
b. The teacher MUST be adequately prepared for the classes in advance, preparing a detailed lesson
plan for every class, every day.
c. Throughout the term of the contract, teachers must maintain a clean and neat appearance. While
suits and ties are not mandatory, a professional attire and appearance is desirable. (Banned: t￾shirts, tethered clothes, clothes with holes, body piercing, revealing tops that shows the waist,
thongs, long hair (for men),unshaven beard, skin head, showing of underwear or not wearing
underwear.
d. The teacher’s work will include the following:
① Teaching the English to students at ...
② Develop educational programs and materials, expanding off of what is already provided in the
[size=78%] curriculum[/size]



③ Curriculum design and implementation
④ Indoor/outdoor classroom activities for/with students


⑤ Level tests, placement by levels, evaluation, check list, monthly report


⑥ providing students with individualized care


⑦ Attending teacher’s meetings, training, and workshops
⑧ Other related activities and requirements


⑨ Requiring to clean their classes and public area after finishing classes –Make sure
circumstance is always neat and tidy for safety and sanitation.



CLAUSE 5 (WORKING HOURS) / 제5항 (근무 시간)
a. During the term of this Agreement, the teacher should work in cooperation with the Supervisor or
Director from Monday through Friday, and during special events.


b. Teachers will be required to attend some special events throughout the year (Workshops,
graduation ceremony, etc.), which may fall on a Saturday. The day of working on Saturdays would
include your monthly payment.


c. Teachers will work as Full time worker 9:00 am- 6:00 pm Monday to Friday per week. Inside of
working hours teacher should prepare lesson plans and materials for the class. Class' starting time
and ending time might be different in some cases. The teaching places might be different too.
Classes will be scheduled in accordance with the needs of Employer.
d. Teachers will be required to attend one nights and two days’ workshop. Workshop attending is
essential for all the teachers. And require working on March 1st for new semester preparation.
Teachers do not receive additional compensation for these days, are including your monthly pay.
 
CLAUSE 6 (SALARY) / 제6항 (월 급여)
a. The Employer will pay a monthly salary of total 2,300,000 won- 2,100,000won (Taxable)
200,000won (non-taxable) (Korean currency). About 3.3% of Employee's salary will be paid to the
Korean Government Tax every month.

b. The payment of the teachers’ salary is to be made on _10__of each month, after the required work


CLAUSE 13 (SEVERANCE PAYMENT) / 제13항 (퇴직 수당)
Upon completion of this one-year contract, the teacher will receive a severance payment of one
month’s salary, as mandated by the Korean workers protection legislations. This payment will be
made at the time of completion of the contract period and any and all income taxes are to be withheld.
The severance payment will be pay at the next payday which is 10th
.

CLAUSE 14(DISMISSAL OR VOLUNTARY RESIGNATION) / 제14항 (해고 또는 자짂 퇴사)
a. The employer reserves the right to dismiss the teacher from employment for the following:



① In this case the teacher is received three written warnings because the teacher fails to perform or
unsatisfactorily performs any one of the duties stipulated in this agreement.


② The Teacher fails to perform duties for more than three(3)consecutive days without any clear
excuse.


③ Criminal behavior or misconduct according to Korean Law.


④ Failure to fulfill one’s duties or damaging the business operation of the school due to reasons of
the teacher’s interests in employment elsewhere.


b. The employer agrees to give the employee the courtesy of 30 working days notice in the event of
dismissal. However, in the case of a teacher’s criminal behavior, misconduct, or with any discretion
thereof, he/she will be dismissed from employment immediately, without warning or notice. Overall,
the employer reserves to right to dismiss an employee at any time.


c. In the event the teacher resigns from employment, he/she can do so giving 60 working days notice
to the employer.


d. In the event that the employee terminates his/her contract with the employer, the following
procedure must be completed:


1. Notice of termination must be submitted to the employer at least 60 working days in advance.


2. Notice of termination must be given in hard copy, dated, and signed by the employee and
employer.


e. Where the employee terminates his/her contract without completion of the contract year and giving
notice of termination for 60 working days, the following effects will take place:


I. Employee must give monetary compensation for the fees paid by the employer regarding the legal
employment procedure of said employee, including recruiting agency fees, health check fees,
immigration registration fees, completed airfare purchases- if applicable, remaining rent fees of the
lease under which the employer resided, paid holidays, and salary deductions to provide for the
recruiting procedure for a replacement teacher.

What is this list lol. have they had teachers in the past who turned up with ragged clothes and no underwear, or do they just hold a very dim view of ESL teachers? The hair/beard outlines are unnecessary too.

4D:
Immense amount of work and vague. I would give the job a pass based on this section alone. Curriculum design/development and teaching and individual care and testing and evaluations and reports? Nah

5:
Unpaid Saturday work.  9 hour work days but a vague mention of differing hours and even work location (sounds like being sent to work for another school (illegal on E2)).
Unpaid training and workshops.

6:
Low salary for the work and hours. 3.3% tax rate indicates this is an independent contractor position, this is a scam to avoid proper contributions to tax/medical insurance/pension. You will likely run into issues with this later. Also a sign the employer is going to screw you financially and professionally.

7-12 omitted, I would be interested in seeing what those said for a laugh

14.4:
You should never be held responsible for the recruiter fees, nor any of that about rent/replacement/paid holidays at the end


IMO don't take this job or you will regret it.

What Renma said. Contract terms and conditions are only clear in that this hagwon is shady as hell, they're doing illegal shit, they're going to cut costs at YOUR expense, and they're going to throw you under the bus if that shit hits the fan.

Hard pass.

9 to 6 for 2.1 to 2.3 million won?  Plus they will fly you to a nearby international airport?  But it omits flying you there?  The appearance?  If you want a beard maybe neatly trimmed, grow one.  If you want some length to your hair grow it.  If you want to shave it off due to balding or whatever do that too.  They can get bent.  Plus a lot of other vague working condition clauses such as submitting a formal written lesson plan before each class.  For 2.1 million, not a chance.  I may tolerate their strict horse-crap for 3.5 million but not a penny less.  Plus dressing up?  I normally wear jeans and a t shirt or a polo shirt or whatever.  I have for years.  For them,?  Suck a lemon.

Putting this right at the top is a huge red flag. It means people run from this place all the time. I'd have honestly stopped reading there for any reason beyond laughs.

No mention of vacation, health insurance, pension, housing details, number of classes per week, length of classes. Hard pass.

It does after I replied to it.  But on the original post it doesn't have anything.  He must have quit or been banned.
