New to teaching ESL, hagwon contract

Hello,
Ask someone new to the scene, I'm interested for the opinions of veterans who've underwent multiple contracts in their lifetime.
Rather than a job for teaching children, this contract is to teach English conversation classes with adults, but the hours are somewhat worrying which is why I'm hesitant. Any feedback is welcome, thank you!.   

CLAUSE 1 (APPOINTMENT)

a. The employer agrees to employ the teacher during the period stipulated herein.

b. The teacher agrees to accept employment and will work in his/her full capacity for the school.

CLAUSE 2 (PERIOD OF EMPLOYMENT)

a.    The total Agreement term is for one year, commencing from the first teaching day, ending on the last teaching day.

b.   During the duration of this contract and without prior consent of the employer, the employer can deny a release letter to the employee seeking another job position elsewhere.

CLAUSE 3 (THE EMPLOYER’S RESPONSIBILITIES)

a. The employer is required to provide support to the teacher in his/her full capacity, working together to provide quality English instruction under the terms stated in this contract.

b. The employer will honor the terms and conditions of employment, as stated within this contract.

c. The employer will guarantee the teacher a salary of  2,200,000 Korean Won in consideration of the teacher’s teaching hours and proper preparation for the classes.


CLAUSE 4 (THE TEACHER’S RESPONSIBILITIES AND DUTIES)

a. During the terms of this Agreement, the teacher must cooperate and comply with the instructions and disciplines of the school. Assisting the ‘Supervisor’ or ‘Director’ he/she must carry out assignments as directed by the employer. The ‘Supervisor’ or ‘Director’ will be responsible for establishing and communicating the ‘Standards of Performance’ as related to the duties stated in this contract.

b. The teacher MUST be adequately prepared for the classes in advance, preparing a detailed lesson plan for every class, every day.

c. At all times during the term of this contract, teachers must maintain a clean and neat appearance. While suits and ties are not mandatory, a professional appearance is desirable. (no shorts, holes in clothing, visible piercing(s), etc.)

d. The teacher’s work will include the following:

①   Teaching the English to students
②   Indoor/outdoor classroom activities for/with students                               
③   Level testing, grading, evaluation, and assessment of students                           
④   Providing students with individualized care                                         
⑤   Attending teacher’s meetings, training, and workshops                           
CLAUSE 5 (WORKING HOURS)

a.   During the term of this Agreement, the teacher should work for 6hours40min. teaching a day
1st  class 6:40am to 7:30am
2nd class 7:40am to 8:30am
    Break time
3rd class  10am to 10:50am
4th class  11 am to 11:50 am
    Break time
5th class   5pm to 5:50 pm
6th class   6pm to 6:50 pm
7th class   7pm to 7:50 pm
8th class   8pm to 8:50 pm

 in cooperation with the Supervisor or Director from Monday through Friday (Working hours are flexible according to the timetable of School.

b. The teacher agrees to teach 33 hours 20min.( a week, while adequately preparing for each class.

c. The Employer may ask the Employee to work over time (the Employee has an option to refuse and will not be forced), and if the Employee chooses to do overtime, the Employer will pay for the overtime at the rate of  15,000 won.


CLAUSE 6 (SALARY)

a.  1 hour is equal to 60minutes .
(Eg. Two 40min. lessons are equal to 1hour and 20 minutes teaching hours.)

b. The employer agrees to pay the teacher salary of   2,200,000  Korean Won/Month  for teaching and preparation for classes.

c. The payment of the teachers’ salary is to be made on  15th   of each month, after the required work is

d. Lateness: If the Employee is more than 10 minutes late to the class, without notification, an hour rate
of payment may be deducted. If one hour is missed, one day of pay may be deducted.

Absence: If the Employee is absent to the class, without notification, 7 days of payment may be
deducted. Any “non approved” absence will be a cause for early termination from the institute.

CLAUSE 7 (TAX)

3.3% Income tax with inhabitants’ taxes will be withheld from the salary in accordance with the Korean laws.

CLAUSE 8 (TRANSPORTATION)

a. One-way economy airfare is provided with the one-year contract from the teacher’s nearest airport to the international airport in Korea.
b. If the teacher leaves the school prior to completing 12 months for any reason as agreed to in this contract, the teacher must reimburse the school the cost of the airfare (for 6(six) month) and recruitment service fee (for 1(one) year) paid by the school or the school may deduct the equivalent amount from the teacher’s last month’s pay to relocate teacher’s cost


CLAUSE 9 MEDICAL INSURANCE

a. Medical insurance is to be provided by private health insurance company/organization.
a. 보험회사의 건강상해보험 을 가입해준다.
c.   Half of the insurance premium is to be paid by the employer, while the other half is to be covered by the teacher.

CLAUSE 10 (VACATION, HOLIDAYS AND SICK DAYS)

a.  The teacher will be allowed holidays during national holidays, while vacation days are allowed only during the days allowed/stated in the school session .The holidays are 10 paid working days a year. (5holidays in the summer (from the end of July to the beginning of August) and 5 holidays in the winter (from the end of December to the beginning of January) have to fall on the same holiday schedule of School)

b.  The teacher may use up to 3 paid sick days per year provided they bring a doctor’s note from a company-recognized hospital. Any additional sick days beyond the 3 provided will be counted as absences, and the payment will be calculated according to the daily rate/hourly rate.

CLAUSE 11 (ACCOMMODATIONS)

a. The school will provide the teacher with furnished accommodation.

b. Furnishings being provided by the employer include: television, refrigerator, washing machine, bed,  Air-conditioner, gas hot plate. The teacher will be expected to provide his/her own pillow, pillowcase, and sheets, etc.

c. Selection of the apartment and its location is to be made by the employer, and will be made without consulting with the teacher.

d. The deposit and monthly rent is the full responsibility of the employer.

e. Any and all other living costs are to be the full responsibility of the teacher. (All utilities: gas, electricity, telephone, cable, internet, etc.)

f. For the first two months, the Employer will withhold a safety deposit of 200,000 Korean Won each month, for a total deposit of 400,000 Korean Won. This deposit is used to pay off utility and telephone charges unpaid at the resident, if any. After the employer clears all utilities and miscellaneous bills and conformation is received, the deposit (minus any remaining dues) is to be returned to the teacher.  However, if the total remaining dues exceed the 400,000, the teacher is entirely responsible, and is to satisfy all debts with the employer and/or utility companies.

g. Any and all unpaid balances of services utilized while residing at the furnished apartment is the responsibility of the teacher bills have been paid will be given to the teacher on the day of teacher’s depart.


CLAUSE 12 (SEVERANCE PAYMENT)

Upon completion of this one-year contract, the teacher will receive a severance payment of
 2,200,000 Korean Won, equal to one month’s salaries, in accordance with Korean Laws. This payment will be made at the time of completion of the contract period and any and all income taxes are to be withheld.


CLAUSE 13 (DISMISSAL OR VOLUNTARY RESIGNATION)

a. The employer reserves the right to dismiss the teacher from employment for the following causes:

①.   Neglect or inability to perform his/her duties stipulated in this agreement

②.   Frequent absences from work

③.   Receiving three times warning letters

④.   Criminal behavior or misconduct according to Korean Law.

⑤   Failure to fulfill one’s duties or damaging the business operation of the school due to reasons of the teacher’s interests in employment elsewhere.

b. The employer agrees to give the employee the courtesy of 20 working days notice in the event of dismissal. However, in the case of a teacher’s criminal behavior, misconduct, or with any discretion thereof, he/she will be dismissed from employment immediately, without warning or notice. Overall, the employer reserves to right to dismiss an employee at anytime.

c. In the event the teacher resigns from employment, he/she can do so giving 60 working days notice to the employer.


CLAUSE 14 (GOVERNING LAW & JURISDICTION)

a. This Agreement is governed under the laws of the Republic of Korea and any breach of this contract, of any form, may result in prosecution through the legal system in the Republic of Korea.

b. This Agreement is made final and firm unless any material modification or amendment to this Agreement is executed with the full knowledge and consent of the undersigned and incorporated into this Agreement.

I had a schedule similar to that a couple of years ago. 9-12 teacher training, 1-4 teacher training, 6-9 adults general English. It nearly killed me for a month but I was making 450,000 won a day. Work out exactly what you'd be getting paid an hour and it'll look very poor.

Those two clauses would make me run.  Also the hours.

a.   During the term of this Agreement, the teacher should work for 6hours40min. teaching a day
1st  class 6:40am to 7:30am
2nd class 7:40am to 8:30am
    Break time
3rd class  10am to 10:50am
4th class  11 am to 11:50 am
    Break time
5th class   5pm to 5:50 pm
6th class   6pm to 6:50 pm
7th class   7pm to 7:50 pm
8th class   8pm to 8:50 pm


You should be getting over 3 million won a month for a bs schedule like that.  I realize a long break in the middle.  But it ruins your whole day.  A typical class hour in a hakwon is 45 or 50 minutes.  But they count each 40 minute class as 40 minutes instead of a class hour.  There was also a clause saying their schedule could change.  IE, less break time and more straight teaching for similar salary. 

Only do it if you will get paid well.  2.2 ain't worth it.
